Multimodal Transport
In legal terms, multimodal transport involves the movement of goods utilizing various modes of transport under a single transport agreement. Unlike specific regulatory laws governing individual modes of transport with their own liability rules, multimodal transport agreements do not neatly fit within these frameworks. Consequently, for a Non-Vessel Operating Common Carrier (NVOCC) offering multimodal transport services, determining liability in the event of goods damage can be challenging. Furthermore, laws vary from one jurisdiction to another, adding to the complexity. While uncertainty maybe difficult to eliminate, robust agreements or general terms and condition scan help mitigate gaps in existing legislation.
Third Party Logistics (3PL)
A freight forwarder frequently takes on various tasks, including both carriage services and forwarding assignments, which may include 3PL. These 3PL services often encompass both carriage and other associated services such as handling and storage, which do not always involve any carriage. This complexity can make it challenging to distinguish between these different aspects. Additionally, there are risks associated with 3PL providers assuming uniform responsibility for their clients due to mandatory transport liability.
